Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Zynthy (the “Service”), operated by Zynthware. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Accounts
You must provide accurate information and are responsible for activity under your account and for keeping your credentials secure. One account represents one billable tenant with a single owner; you are responsible for the users you invite. You must be at least 18 and able to form a binding contract.
2. Acceptable use
You agree not to misuse the Service — including sending unlawful, deceptive, or unsolicited messages, violating the rights of others, attempting to breach security or access data that is not yours, or reselling the Service without authorization. When sending review requests or marketing messages through the Service, you are responsible for complying with all applicable laws (including the CAN-SPAM Act, TCPA, GDPR, and the platform policies of Google, Meta, and others). You may never solicit or suppress reviews based on predicted sentiment.
3. Your content and data
You retain ownership of the data and content you submit. You grant us a limited license to host, process, and transmit it solely to provide the Service. You are responsible for having the rights and consents needed for the contact data you upload and the messages you send.
4. Fees and billing
Paid plans are billed in advance on a recurring basis and, where applicable, include usage-based charges disclosed at signup. Fees are non-refundable except where required by law. You may cancel at any time; cancellation stops future renewals and you retain access through the end of the paid period. We do not lock you in — you can export your data and leave.
5. Third-party services
The Service integrates with third parties (e.g. email delivery, payment processing, and Google/ Meta business profiles). Your use of those integrations is subject to their terms, and we are not responsible for third-party services.
6. Availability and changes
We work to keep the Service available but do not guarantee uninterrupted operation. We may modify or discontinue features, and we may update these Terms; material changes will be communicated and continued use after they take effect constitutes acceptance.
7. Disclaimers and limitation of liability
The Service is provided “as is” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Zynthy and Zynthware will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amounts you paid for the Service in the twelve months before the claim.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for material breach of these Terms, with notice where practicable. Sections that by their nature should survive termination (ownership, disclaimers, liability limits) survive.
